During the hearing on the constitutional validity of the Aadhaar today, Justice DY Chandrachud came down heavily on the Union Government's move to introduce the Aadhaar Bill as a Money Bill in the Rajya Sabha and went to the extent of calling it "a fraud on Constitution"

While dissenting with the majority, Justice Chandrachud said that there was no need for passing the Aadhaar Act as a money bill.

"Aadhaar cannot be treated as money bill and passing a bill as money bill which is not a money bill is a fraud on the Constitution"

"The Aadhaar programme violates informational privacy, self-determination and data protection."

He also agreed with the majority decision that mobile companies cannot insist on Aadhaar. "The mobile phone has become an important feature of life and its seeding with Aadhaar poses grave threat to privacy, liberty, autonomy," he said.
