GHC bans bandh, orders SPs to file FIR

Gauhati High Court bans bandh, to monitor anti bandh action and asks SPs to personally file FIR against all those who give bandhs, road blockade and rail blockade besides reporting to Home Department with damage details in 7 days.

An angry Guwahati High Court today took the anti bandh matter to their own hand and ordered each of the District Superintendent of Police to personally file FIR against any organisation who give any type of Bandh, rail and road blockade program.

Mr. Justice Uzzal Bhuyan ordered that the Court will monitor the anti bandh steps taken by the SPs every three months and ordered the SPs to submit the bandh related report within 7 days of the incident.

The Guwahati high court several times announced the bandh as illegal and asked the State Government to make law to ban bandh. But successive state governments have been dilly delaying the matter.

    • SP to file FIR within 24 hours
    • Home Department be informed in 7 days
    • Charge sheet against the Bandh callers
    • Assam Police Accountability Commission to monitor SPs
    • Home Department to file contempt cases
    • Departmental proceeding against SPs who do not file Charge Sheet against Bandh callers.
    • High Court to file contempt case against Home Department if no Contempt case filed by them
    • Home department to ascertain damage and to be recovered from the office bearers of Bandh Callers
    • A Bandh Loss Compensation Fund to be created
    • After recovery, the money will be kept in the Fund and from there loss disbursement will be carried out.
